Autistic IEP Child gets dismissed from Elementary School for behavioral issues.

To whom it may concern,

How long does it take for a student to begin a new school after being dismissed from another? Our son was dismissed from his Elementary School because of supposed behavioral issues that we believe he did not do. We had a meeting, have met the new schools Principal, & behavioral specialists, yet have yet to hear back from the new school. It's been over a week now. Any suggestions, ideas, etc. would be appreciated. I hope that I didn't misuse this.

I am going to need more information--when you say "we had a meeting" what do you mean? IEP meeting? Manifestation meeting?

 

And when you say dismissed, do you mean suspended or expelled? From your neighborhood public school?

Honestly, this is more than an online forum can help you with. Expelling a child from school is a HUGE deal, and every state requires the school district to go through a very specific process. Sounds like that did not happen and you need an attorney.

A school cannot just hold an online IEP meeting and then expel a kid, except under a few very specific circumstances--and that would be something like a huge amount of narcotics, or a gun, something like that.

Transferred from one public school to another isn't the same as being expelled. It may be that the new school is better anle to assist with you child's specific needs.

If a student gets expelled, it's still on the public school to provide an education.  Not sure how long it should take to get transportation set up to get him to the new school.  (If his IEP wasn't FAPE, it might not have had enough support to prevent this from happening.  This is where an attorney can help.)  It might be the public school who is causing the delay in the start date as they are the ones who might need to transport.
