  1. Pennsylvania here i submitted a FERPA request. They’ve contacted me to set up a time to access and view the records I requested. I understand I can request copies for a fee. but what I can’t find anywhere is can I take photos of the documents with my phone, rather than pay for copies? does the law specify this anywhere? If so, I’d love to know where.
  2. Pennsylvania if it matters. School team removed “consecutive” from all goals in their most recent revision. So, for example, instead of reading “3 out of 4 consecutive trials,” they read “3 out of 4 trials.” Child has never had an issue meeting goals before. In fact, child is very quickly closing gap between peers. I stated that it will make it easier for him. One team member said sometimes kids have a bad day and if they miss it once, they have to start over again if it says consecutive. Another team member said having consecutive is an unnatural mastery. I can’t find any solid data for a good argument against it but I don’t agree with it because it’s making it easier for him, and then for them to remove his IEP. what are some good arguments to keep “consecutive” in his goals? Is this even a fight worth fighting?
  3. Pennsylvania if it matters I always send very detailed after IEP meeting notes. I have always closed by saying if I missed or forgotten anything, to please reply by a deadline (usually 2 or 3 days) while memories are still fresh. The team never used to respond but they did for the last two meetings. For the most recent meeting, they straight up asked me to remove something and send them a revised copy by Monday because they claimed they verbally said something else in a meeting two months ago. I reviewed the notes from two months ago and it’s not in there and she did not contest it then, although someone else did contest something else for herself and something else unrelated pertaining to this person, but not this new issue. first question, Can I let it in my notes and simply make a footnote and refer to their email and the meeting notes before for which they claim they said it then (but it’s not in there and was not contested then), second question, should I stop asking for input on my notes? I send to the entire team. third question, If I don’t request input, and they don’t respond, will my notes legally hold up if I ever find myself in due process or making a state complaint, etc.? fourth question, if they disagree with my notes, are they required to reply even if I don’t request it? Fifth question, We just had another meeting yesterday and I need to send out notes for this meeting - but I don’t know if I should include my standard clause requesting input because of the issue it is causing right now?
  4. Pennsylvania Help! We had our annual on Tuesday, 1/17/23. We did not finish the meeting due to disagreement so we set up another meeting for tomorrow, Friday, 1/20/23. This is the date that the district needs me to sign by so they are not out of compliance. However, I would really like to bring the draft IEP and NOREP (PWN) home over the weekend to review. I’ll likely agree to it and I don’t want them to be out of compliance. But is it my legal right to be able to bring home the draft IEP and NOREP (PWN) to review? Can someone please confirm that I do have 10 days to return the NOREP (PWN) that will be provided to me tomorrow despite this potentially placing the district out of compliance?
  5. My 3 year old’s pediatrician and his preschool teacher referred him to our IU for assessment. It was performed and his teacher told me “the evaluator saw signs but she wasn’t sure if it was enough to qualify him for services.” how does this work? Why wouldn’t the evaluator know if it’s enough to qualify? Isn’t that her job? Does she need to take it to a superior to see if he qualifies? I’m looking for information on how this process works. Can anyone help? if they deem he doesn’t qualify, do I have any rights to pursue it in some way since it was his doctor and teacher that referred him? I believe he needs supports.
  6. Does anyone know of any decent advocates in the Adams County, or surrounding counties? or how to go about finding one? I’m not interested in contacting the standard places listed on the school’s procedural safeguards packet that they are required to hand out. I’m looking for an advocate who is really there for the child, not one who will just take the school’s side.
  7. Are all meetings with IEP teams supposed to receive a formal invitation? The school and I disagreed about something. I indicated it on the NOREP/PWN but checked the I agree box. The learning support teacher sent me an email, cc’d the team, and set up a meeting to discuss. This was last week; meeting is next week. Ordinarily, they send me a formal meeting invite to return but I have not received one for this meeting. is it possible to have an “off the books” meeting? I thought all meetings required the formal invite in Pennsylvania.
  8. Help! School just emailed me an hour ago. It’s Friday afternoon and they want to have an IEP meeting this Tuesday morning. I’m a SAHM and I can not find childcare that quickly and my husband cannot even get off work that quickly. I’ve been searching for federal or PA law about how much notice school has to give us — because this quick turn-around does not feel right — but I can’t seem to find anything except “some states say 10 days” for notice of an IEP meeting. But I don’t know if PA is included in that. Can someone help me find the law or regulation that states this so I can get them to reschedule so my husband and I can both be in attendance? Also, do I need to give them a reason why this date/time won’t work if there is no law/reg. Thank you!
