Smiley74
If a child has an IEP, 504, and any other ed plan, they all go into the IEP. But since each have their own safeguards if separate, does each keep it's own safeguards and rights even though they appear in the IEP??
0 Moderators Jenna Posted December 16, 2022 Moderators Share Posted December 16, 2022 The procedural safeguards under the IDEA (IEP) are greater than for a 504. See https://adayinourshoes.com/difference-504-iep/. You can still file an OCR complaint for a violation of civil rights if your child has an IEP.
0 JSD24
A 504 accommodation in an IEP can use either IDEA or Section 504 procedural safeguards. Health Plans aren't covered by an agency so they do not have safeguards. If they are in an IEP, I believe you can go with IDEA safeguards.
